1. Introduction
1.1 This agreement sets out what we agree to do for you and what you agree to do for us in relation to the cash card ("the card") we give you to use with your Egg Savings Account ("the account") and adds to our customer relationship agreement with you.
1.2 In this agreement "we", "us", and "our" mean Egg Banking plc, and "you" and "your" mean the person in whose name the account is held or, if there is more than one person, all of them. "Business day" means a day other than a Saturday, Sunday or Bank Holiday in England.
2. Using the card
2.1 You can use the card wherever you see displayed the VISA PLUS logo in or outside the UK to make cash withdrawals from your account up to the amount available on your account and for any other purpose we tell you about from time to time. Condition 5.7 of the General Terms and Conditions does not apply.
2.2 We will tell you how much you can withdraw using the card on one day.
2.3 All cash withdrawals will be shown on your statement. They will normally be taken off your account immediately.
2.4 We will convert all foreign transactions into sterling and we will charge 2% commission for doing so on the amount of the cash withdrawal. As rates can change on a daily basis, the exchange rate we use may not be the same as the rate when the cash withdrawal was made.
2.5 Some banks may charge for the use of their cash machines and you authorise us to deduct these charges from your account.
3. Security
3.1 You must:

take reasonable steps to keep the card safe and the personal identification number (PIN) secret at all times;

never allow anyone else to use your card;

never write your PIN on the card or on anything you usually keep with it. You must destroy your PIN notification as soon as you have read it. If you do keep a written record of your PIN you must make a reasonable attempt to disguise it;

only reveal the card number to report the loss or theft of the card or if we ask you to do so. Even in these circumstances you must not tell us (or anyone else) your PIN.
3.2 Cards belong to us. We can ask you to return them to us and we can ask others to hold on to them for us at any time.
3.3 You must tell us as soon as you can if the card is stolen or you think that the card may be misused, or you think that someone else may know the PIN or your statement includes an item which you think is wrong. We may ask you to confirm in writing within seven days any information which you have not already given us in writing.
3.4 You must give us all the information you have about the loss, theft or misuse of a card or the PIN, and any other information we ask for to help us. We may give the police any information we think will be useful. If you find cards which you have reported as lost, stolen or at risk of misuse, you must not use them. You must cut them into more than two pieces and throw them away.

4. Limits of liability
4.1 If we have a good reason, we may without first telling you:

cancel or suspend your right to use the card for any or all purposes;

refuse to replace or reissue any card.
This agreement will continue even if we do any of these things.
4.2 We will not be liable if you cannot use the card for a cash withdrawal.
4.3 We will not be liable to you for any failure to perform our obligations under this agreement due directly or indirectly to the failure of any machine, data processing system or transmission link, any industrial action or anything outside our control or the control of our sub-contractors or agents.
4.4 Until you tell us under condition 3.3 that your card is lost or stolen or may be misused, you may be liable for any cash withdrawals up to the time you let us know up to a maximum amount of £50. If someone else uses your card details without your permission for a transaction where the cardholder does not need to be present, you will not have to pay anything. If your card is used before you have received it, you will not have to pay anything.
4.5 If you let someone use your card, you will be liable for all the cash withdrawals which take place before you tell us that it may be misused.
5. Changing the terms of this agreement
We have the right to vary our charges and to change these conditions to make them fairer to you or more easily understandable, to correct a mistake or to cover a development in our services. Normally, we will give you not less than 30 days prior notice of any material change or addition, by writing to you or by advertising in up to three national daily papers.
6. Ending this agreement
This agreement will end if you or we have given notice to the other or you close the account. We may give you replacement cards from time to time until the agreement ends.
7. General
7.1 We will charge you for any losses or costs we have to pay if you break this agreement.
7.2 You must tell us immediately if you change your name or address. If you do not do this, we may charge you any expenses we incur in tracing you.
7.3 This agreement is governed by the law of England and Wales.
